Plat vs. Survey – What’s the Difference?

Plat

     “Plat” and “Survey” are two terms that are often used interchangeablably in real estate. However there are differences between the two.  Listed below are the differences and similarities between plats and surveys.

What they have in common:

  1. They are both a depiction of a tract of land
  2. They can show a very small tract or a very large tract
  3. They both show the dimensions of the property
  4. They both show the location of the property (county, land lot, district, abutting streets etc.)

How they differ:

  1. A survey will show any dwellings, buildings or improvements (driveways, fences, pools) located on the property;
    A plat usually shows the dimensions of the property before the improvements are made.
  2. A plat will often cover more than one lot or parcel of land. For example: a developer will have a plat of an entire subdivision drawn;
    A survey usually only shows one lot or a limited number of lots.
  3. Plats are often drawn in order to be recorded at the courthouse for public use; surveys are usually only for the personal use of the owner of the property.

Deceased Sellers… How Probate Works…

     The sad reality of life is that loved ones pass away.  When they do, if they own real property there are usually complications as to whom gets the property and whom doesn’t.  If the home owner doesn’t have a will, the situation will be much more complicated.  Hopefully, they do.  If a person wants to sell a house, you need to see a copy of the warranty deed, showing how title is vested.  You need to see if the seller has been appointed executor for the estate by a final order in probate court. 

     For those of us who don’t know what that means, it is the legal process of settling an estate of a person that has passed away.  The first part is appointing a person as Executor.  This person resolves the issues regarding a person’s personal and real property.  Probate must happen and be appointed in the county that the deceased person lived.  Most counties in Georgia, have a section on their website with more information (http://www.gaprobate.org/). 

    If your seller has been appointed Executor, you need to make sure to tell the attorney that is closing the sale of real property.  There will be many things they will need to verify, including correct title.  Now, if the estate has not been probated, your seller must start the process immediately!  It can be very time consuming, and will most likely be needed in order to close on the sale of the house. 

     If only one of the owners has passed away, there are several different questions you may need to ask.  You will need a obtain a copy of the existing Warranty Title to see how title is held.  In the state of Georgia, there are two most commonly used types of warranty deeds.  The most common one is “Joint Tenants with Right of Survivorship” and the other one is “Tenants in Common.”  Joint Tenants with Right of Survivorship is when one of the owners passes away, the other joint tenant(s)  automatically passes title to the other one.   In this instance, probate is not usually necessary, but the attorney will need a copy of the death certificate.   Tenants in Common is when the title does NOT automatically pass to the other living tenants(s).  In this case, the heirs to the deceased owner will need to probate the estate, as discussed above.

Preparing Your House to Sell – Inside and Out!

In preparing your house to sell, ask yourself over and over if your house looks like someone else’s dream house. Houses in move-in condition tend to be inviting to buyers; houses that are like-new typically sell the fastest and procure the best price.

With that in mind, here are a few things to consider when getting ready to sell:

Exterior
Remember the 60-second rule: that’s all the time you have to create a good first impression! Mow the lawn, rake leaves, trim trees and shrubs that keep light out of the house and remove dead plants. Pick up tools, garbage cans, hoses, toys, and building materials and store them neatly in a storage area. Replace broken or missing roof shingles and straighten and clean the gutters and downspouts. Clean all windows and mend torn screens. Painting your house helps improve curb appeal more than any other fix-up! If you decide against painting the entire house, consider painting the front door, window frames and shutters. Seal or resurface the driveway and repair broken steps and walkways. Paint or replace your mailbox and post. Dress up the front yard with some simple landscaping.

Clean, Clean, Clean
Step back for a moment and look at your home as if you were seeing it for the first time. Every room should be spotlessly clean, dusted and uncluttered. Steam clean the carpets and wax the floors. Wash the walls, windows and light fixtures. Tighten loose stair railings and clean all woodwork. In the event that you feel a project of this magnitude is better left to a professional, ask us to recommend a cleaning service.

Entryway
Use bright light bulbs in the foyer and throughout the house. Fill the house with a pleasant aroma, such as berries in the summer or cinnamon in the winter.

Living Room
Replace the carpet if it’s worn. It costs money, but you may find that you will more than recoup that cost when the home sells. Patch cracks and nail holes in the walls, and repaint walls in neutral colors, such as beige or ivory. Nail down creaking boards and stair treads. Lubricate any sticking or squeaking doors. Open all curtains, and replace them if they are getting old. Add lamps and lighting if the house is dark. Set out fresh flowers.

Furniture
Rearrange or remove furniture to make your rooms look more spacious. Too much furniture and too many knick-knacks make rooms look cluttered and small. One or two decorative items per surface are plenty, so pack the rest away.  In fact, make it a practice to start packing now!  Anything that isn’t frequently used should be packed away to encourage a speedy closing!

Kitchen and Baths
These rooms should sparkle! Clear off counters, and clean all appliances and fixtures. Scrub the floors and walls. Re-caulk tubs and showers. Clean these rooms thoroughly, and be sure they smell fresh.

Closets
Take those things to Goodwill that you’ll have to discard anyway when you move. Organize shelves and straighten shoes. Be sure that sliding doors operate smoothly and knobs on drawers are secure.

Utility Room
Dust and wash the washer, dryer and water heater.

Light and Bright
Do everything you can to brighten the interior. Replace wallpaper with a neutral paint, and repaint shabby or dark walls. Open the blinds, and replace broken windows and window seals. Always maintain a comfortable temperature inside the house, even if you are away for an extended period of time.

 We know these things may seem picky, but let me tell you one thing: when we sold our house in Vermont to move to Georgia, we had a contractor come in and repaint all the walls and trim, repair those “fixer-upper” jobs that we had started (and not finished), and steam clean the carpets.  Total, it cost us about $2000.  We received $25,000 MORE because of the improvements we had made!  Incredible, huh?  That’s what we thought, too!

Are You Heading for Foreclosure? Here are Some Tips to Help Avoid Foreclosure!

          Over 4 MILLION families have lost their homes due to foreclosure in the last 18 months!  Many of them have been hit by the Adjustable Rate Mortgage (ARM) Crisis!  This happens because they purchased their home between 2-5 years ago, and at the time Adjustable Rate Mortgages were the best way they could qualify for a home of their own.  No one could foresee that the rates would go up so much!  I have put together some advice that I hope will help you avoid the ugly word: FORECLOSURE! 

  • Please DON’T ignore your lender!!!  More than at any other point in time, lenders are usually willing to help you get back on track, or at least give you a month or two to get caught up.  But, YOU HAVE TO CONTACT them BEFORE you are way behind!  It’s best if you can call and talk to them as soon as you feel you may be getting into trouble.  If the first person you talk to doesn’t help, ask to speak to a manager.  If you are still getting no place, call me!  I’ll help you negotiate with your lender to figure out what the best option is for you! 
  •  Reply to all the mail you get from your lender.  The first month or two that you are late will be supportive inquiries as to help you get caught up, offering financial support.  Keep in mind that in Georgia, by the 3rd month you can be heading for foreclosure.  You do not even have to go to court, for your home to be foreclosed on.  All they have to do is notify you in writing and advertise it in the local County newspaper for 4 weeks.  At that point in time, the sheriff can show up on your doorstep and change the locks!
  • You should know your rights!  If you are getting into financial trouble, you need to pull out your mortgage documents and understand what the lender intends to do if you default on your payments.   You also need to understand what the foreclosure laws are in your state, as well as the time frames. 
  • There are many foreclosure prevention options!  Learn about them and do what you have to do to make it work!
  • HUD (U.S. Department of Housing and Urban Development) offers counselling (free or low cost) that can help you understand your options and the law.  You can find a counselor or call 800-569-4287. 
  • If you are getting into trouble with your mortgage, you may need to prioritize your expenses.  After health-care, you need to pay your mortgage first.  Cut out all your optional items: cable, entertainment, telephone, as well as credit cards and other unsecured debt.
  • Does anyone in your family have the ability to get another job, cash in on a 401K or insurance policy?  Do you have a second car or jewelry you can sell?  You may not bring in immediate funds, but it will show your lender that you are serious about keeping your house! 
  • Another important tip?  Do not sign up for assistance with a for-profit foreclosure prevention company.  They typically charge you thousands of dollars to get information and negotiate your mortgage situation.  I’m not saying they are not reputable businesses, but what I’m saying is that you can get this same support for free from HUD and pay the difference on your mortgage!
  • Last, but not least… NEVER sign documents giving someone else control to “negotiate on your behalf.”  If you are working with someone to help you, they can always have conference calls with you and the mortgage lender, in order to help with your mortgage situation.  The other option is to contact your lender and give them permission to talk to your “support person.”   They will want that in writing, but since it will be a request from you, you will know to expect the paperwork.  ALWAYS read everything, and understand what it says before you sign it!
  • There is another option: givin enough time, you may be able to do a “short sale” on your house.  If you contact your lender early enough, they may be willing to let you sell the house.  If the market will not bring what you owe, they may agree to take less than you owe, but still clear it off your credit, just as if you sold it for full price.  You will not walk away with much, if any, money, but you will have a clear slate on your credit.  Most people do not have any clue about a short sale, but it is an extremely viable option!

          Did you know that if you were to replace a single 75-watt light bulb with an Energy Star light bulb, that you would save over $30 during the life of the bulb??  If you replaced an average of 20 bulbs in your home, you could save over $600!  HUD, the Department of Energy and the Environmental Protection Agency, all want to celebrate the greatness of energy efficiency!  In Georgia, they are calling the campaign “Change a Light, Change the World!”

Closing in Escrow… What Does it Mean?

                 Have you ever gotten pre-qualified to buy a home, searched for a home, done all the paperwork associated with submitting an offer, had your home inspected, provided all the needed documentation to your lender, and actually made it to the closing table?  You thought you had it made, right?  Home free (no pun intended…)?!   But, what happens when the lender doesn’t pay up?  When a currently undisclosed condition stops the closing, and the lender won’t pay until that condition is met? 

          This situation is called “Closing in Escrow” and it happens on an occasional basis, no matter how good all the parties are….  Once in a while, it happens, most of the time as a surprise.  Occasionally, you go into the closing knowing that it will “Close in Escrow” and the best thing you can do is prepare all parties involved.  All the paperwork is signed, for all intense and purposes the closing is complete, only no money is exchanged, and the Seller still owns the home, and the Buyer is homeless! 

          Now don’t panic!!!  More often than not, the condition is able to be met with a little bit of work from the offending party.  Once the condition has been met and the attorney verifies with the lender, approval is gained, funds are released and ownership of this wonderful home is exchanged!  Yippy!!!  NOW YOU ARE HOME FREE!!!!

Mortgage Insurance (MI) Is Now Tax Deductable!!!

         Great News!!!  Did you know that Mortgage Insurance is now tax deductible?!  When you bought your home, if you did not put down at least 20%,  you are most likely paying mortgage insurance as part of your monthly payment.  It could be as little as $30 per month or up to hundreds of dollars!  If your anual gross income is less than $100,000 a year it is 100% deductible.  If your income is between $100,000 and $110,000 it is slightly less.

Credit and Identity Theft… How it Effects You

          Are you fearful of someone stealing your identity?   Thousands of people each year have to deal with the aftermath of ID theft.  In this time of ever increasing online phishing, fraud and credit card theft, people need to be VERY careful about where they voluntarily give out their personal information.  Most people do not keep track of their credit on a regular basis and when they come in looking for a mortgage, they are dismayed by things on their report that they have never seen.   Another confusion can be when there is a Sr. and Jr. in the same family, with the same name.  It is a frequent problem that a son’s credit mistakes can be applied to the father’s, and vice versa. 

             We recommend that you join a credit review company, such as AnnualCreditReport.com to keep track of your credit history.  There are lots of services out there that do this,  this is just one of many, but it is a good idea for you to keep track of your credit history so that when you need to use it, you are in the best possible situation.

          When looking for credit to purchase a home, there are various things to consider.  The top considerations are job history & security, income history, outstanding debt and past payment history.  Lenders look at past history as indicative of future performance, typically.   If you have been in a difficult situation, such as a death in the family, divorce, loss of a job, just to name a few, you can (and should) submit a “personal note” to each of the 3 major credit bureaus explaining the situation.  Although it may not have an immediate impact on your credit score, it will go a long way with lenders that look at personal situations.  With the over 4 million families in the United States that have lost their homes to the “Adjustable Rate Mortgage” Crisis, I really feel that being proactive with your credit situation will work in your favor.  I, personally, believe that there will have to be some updating on the way credit scoring effects our lives. 

          Ok, since I seem to be going on and on, I’m going to end this blog with a personal request that each one of you check out your credit report.  Take a look, BEFORE you need it, and make sure if there is something on it that shouldn’t be there you have it removed, and if there is just plain old “stuff” on there from your life, you have the time to get it cleaned up.  I work with a lender called Pine State Mortgage, who has a credit rebuilding program called Purchase Power.  I would say 70% of my clients need some kind of help with their credit reports, ranging from 2 points that can usually be tweaked in 2-3 days, or 100 points, within 12 months.  The cool thing about Purchase Power, is that they don’t only tell you what you need to do, but they actually help you do it!  That kind of customer service is rarely seen, in the mortgage industry.

Water Ban in Use For Various Northwest Georgia Counties

          Water          According to officials in Northwest Georgia, we have a Level 4 Water Ban in effect until further notice.  Specifically, officials from the Cobb County – Marietta Water Authority have said this may very well be the worst drought in history and we have to become more aware of the need to conserve our water supply for future usage.

          The specific counties that are included in this newest ban are: Paulding, Cobb, Douglas, Cherokee, Fulton, Carroll, Haralson, Heard and Harris.  A Level 4 Water Ban allows for no outdoor water usage.  There are few exceptions as noted by the Georgia EPD.  Officials from the State and Water Authority Board make the ultimate decision as to what Level Ban we are in.   There are serious concerns about Lake Allatoona and Lake Lanier water levels. 

          A Level 3 Ban consists of allowing water usage only one day per week.  A Level 2 Ban consists of allowing outdoor watering during early morning hours on various days per week, depending on area.
